LIABILITY WAIVER

By engaging the junk removal services of Colorado Junk Pickup (“Company,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) unconditionally and irrevocably agree to the terms of this Liability Waiver (“Waiver”), our Terms of Service, and our Privacy Policy (collectively, the “Agreement”), effective upon your failure to object within 24 hours of receiving our confirmation email, as well as through the contact form or verbal consent during booking. If you do not consent, you must refrain from using our services by canceling within 24 hours via 719-314-2444 or [email protected].

1. Acknowledgment of Inherent Risks

Junk removal services, including those provided by Colorado Junk Pickup in Colorado Springs, Fountain, and surrounding areas, inherently carry substantial risks of property damage or personal injury. These risks include, but are not limited to, scratches, dents, structural damage to homes, driveways, or lawns, damage or loss of household items or debris, injuries to persons or pets, and exacerbation of pre-existing property conditions during the removal process. By engaging our services, you expressly recognize, acknowledge, and unconditionally accept these inherent risks as an unavoidable and integral aspect of junk removal, effective through the aforementioned consent mechanisms.

2. Comprehensive Release of Liability

To the fullest extent permitted by the laws of the State of Colorado, you agree that Colorado Junk Pickup, its owners, employees, contractors, and affiliates, shall bear no liability whatsoever for any damages, injuries, or losses, including but not limited to property damage (to homes, driveways, lawns, or items removed), personal injury (to you, your household, or third parties), loss of items, or any other harm, arising from or in connection with our junk removal services. This release encompasses all claims, whether resulting from ordinary negligence, inherent risks, or any other cause, except where gross negligence or willful misconduct is conclusively established by a court of competent jurisdiction. You irrevocably release the Company from all responsibility for such incidents.

3. Irrevocable Waiver of Right to Sue

By engaging our services, you hereby irrevocably waive any and all rights to initiate legal action or pursue claims against Colorado Junk Pickup, its owners, employees, contractors, or affiliates, for any matter related to our services, including but not limited to disputes, injuries, damages, losses, or dissatisfaction, whether based on negligence, breach of contract, or any other legal theory, except in instances of gross negligence or willful misconduct as adjudicated by a court of competent jurisdiction. The Company reserves the unqualified right to initiate legal proceedings against you for non-payment, breaches of this Agreement, or other violations, with you bearing all associated costs, expenses, and legal fees incurred.

4. Customer Responsibilities

You are solely and exclusively responsible for preparing all items for removal, including sorting debris, securing hazardous materials (if any), and ensuring safe access to properties (e.g., clear pathways, parking spaces, permits). You must disclose any conditions that may increase risk, such as fragile structures, heavy items, or restricted access. Failure to comply may result in delays, additional charges, or refusal of service, for which the Company shall incur no liability. You agree to indemnify and hold Colorado Junk Pickup harmless against any claims, damages, or liabilities arising from your failure to meet these responsibilities or any misrepresentations.

5. Pricing and Payment Terms

Pricing is determined by the assigned junk removal professional on-site, based on volume and item type, with standard rates of $150 (small load, 62.9 cubic feet), $350 (half trailer, 144 cubic feet), and $625 (full trailer, 288 cubic feet). Additional fees of $50 apply per mattress, boxspring, TV over 27 inches, or appliance. The Company reserves the unilateral right to adjust prices at its sole discretion upon inspection, and the professional’s determination of pricing tier and additional costs is final. A valid credit card must be on file prior to service. Failure to pay promptly authorizes the Company to charge any card on file for the full amount owed, plus a $50 service fee if payment is not made upon arrival, and collection costs if unpaid. Non-payment may lead to legal action, with you liable for all associated costs.

6. Communication Consent

By providing your phone number, you expressly consent to receive this Waiver and other communications from the Company via text message, calls, or emails, including automated or pre-recorded messages, for purposes such as service confirmations, quotes, and updates, in accordance with the Telephone Consumer Protection Act (TCPA). You may opt out of text messages by replying “STOP” or contacting us at [email protected]. Standard message and data rates may apply.

7. Indemnification

You agree to fully indemnify, defend, and hold harmless Colorado Junk Pickup, its employees, agents, and affiliates against any claims, liabilities, damages, or expenses (including attorney fees) arising from your use of our services, your failure to comply with this Agreement, or any third-party claims related to your property or items removed.

8. Governing Law and Jurisdiction

This Waiver is governed exclusively by the laws of the State of Colorado. Any disputes arising from this Waiver or our services shall be resolved exclusively in the courts of El Paso County, Colorado. You consent to the jurisdiction of such courts and waive any objections to venue. If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Confirmation Email Notification

Prior to each scheduled pickup, Colorado Junk Pickup will send a confirmation email with service details, including date and time, and links to this Liability Waiver, our Terms of Service (https://www.coloradojunkpickup.com/terms-of-service), and Privacy Policy (https://www.coloradojunkpickup.com/privacy-policy). Your failure to object in writing or cancel by contacting us at 719-314-2444 or [email protected] within 24 hours constitutes your full and irrevocable acceptance of these terms.
